Terms of Service

These Terms of Service govern your use of PreOrder Now. By installing or using the App, you agree to be bound by these Terms.

1. Description of Service

PreOrder Now is a Shopify application that enables merchants to add pre-order functionality to products, track pre-orders, manage fulfillment, and send customer notifications.

2. Account and Installation

2.1 Eligibility

You must have an active Shopify store and be at least 18 years old.

2.2 Installation

By installing the App, you authorize us to access your Shopify store data as described in our Privacy Policy and as required by the requested API scopes.

3. Plans and Billing

3.1 Free Plan

Up to 10 pre-orders per calendar month. Resets on the 1st.

3.2 Paid Plans

Billed through Shopify's Billing API. Charges appear on your Shopify invoice. All prices in USD.

3.3 Free Trials

Paid plans may include a free trial. You will be charged automatically after the trial unless you cancel.

3.4 Cancellation

Cancel or downgrade any time through the App. Takes effect at the end of the current billing period. No partial refunds.

3.5 Price Changes

30 days' advance notice for price changes. Continued use constitutes acceptance.

4. Acceptable Use

You agree not to:

• Use the App for unlawful or fraudulent purposes
• Reverse engineer, decompile, or disassemble the App
• Interfere with the App's servers or infrastructure
• Resell, redistribute, or sublicense the App
• Circumvent rate limiting or security measures
• Violate Shopify's Terms of Service

5. Merchant Responsibilities

You are responsible for:

• Accurately representing products available for pre-order
• Setting realistic expected delivery dates
• Fulfilling pre-orders in a timely manner
• Communicating delays or changes to customers
• Handling refunds and cancellations per your store policies
• Including pre-order data processing in your store's privacy policy
• Ensuring "Continue selling when out of stock" is enabled

6. Intellectual Property

The App is owned by PreOrder Now and protected by intellectual property laws. We grant you a limited, non-exclusive, revocable license to use the App during your active subscription.

7. Limitation of Liability

The App is provided "as is" without warranties of any kind. We shall not be liable for indirect, incidental, special, or consequential damages including loss of revenue, data, or customers. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless PreOrder Now from claims arising from your use of the App, violation of these Terms, or disputes between you and your customers regarding pre-orders.

9. Service Availability

We strive for high availability but do not guarantee uninterrupted service. The App depends on Shopify's platform and third-party infrastructure. We may perform maintenance that temporarily affects availability.

10. Termination

By You

Uninstall the App at any time through Shopify admin.

By Us

We may suspend access if you violate these Terms, your store is terminated, you fail to pay fees, or we're required by law.

After Termination

Your license ends, pre-order buttons are removed from your storefront, and data is handled per our Privacy Policy.

11. Dispute Resolution

Contact us to attempt informal resolution for at least 30 days before filing a formal dispute. Any claim must be filed within one year.

12. General

• These Terms and Privacy Policy are the entire agreement
• Invalid provisions do not affect remaining provisions
• Failure to enforce a right is not a waiver
• You may not assign these Terms without consent
• We are not liable for delays due to force majeure

13. Changes to Terms

We may modify these Terms with 30 days' notice. Continued use after changes constitutes acceptance.
